Californians passed the California Privacy Rights Act (CPRA), or Proposition 24, in November 2020. The CPRA definitively adjusts and increases obligatory privacy actions under the California Consumer Privacy Act.
Amending certain definitions, the CPRA is primarily concerned with business and personal information. However, it also speaks to other legislative and human resources issues, including:
Notices and disclosures to consumers;
Consumer rights; and
Data security.
The CPRA will be in effect on January 1, 2023, except the right of access to personal information. That aspect of the act is subject to a 12-month lookback period and will apply to personal information collected by a business on or after January 1, 2022. However, enforcement will likely not come into effect until July 1, 2023.
